1 Introduction

Welcome to pk5d. These Terms & Conditions ("Terms", "Agreement") govern your access to and use of the website located at https://pk5d.cam (the "Platform"), operated by pk5d ("we", "us", "our"). The Platform is an English-language online betting information service designed for Pakistani users.

By accessing, browsing or using the Platform in any manner, you confirm that you have read, understood and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, you must immediately cease using the Platform.

These Terms should be read alongside our Privacy Policy and our Responsible Gambling guidelines, both of which are incorporated by reference into this Agreement.

2 Definitions

The following terms carry the meanings set out below throughout this Agreement:

3 Nature of the Platform

pk5d is an independent English-language information and education platform. Its purpose is to provide Pakistani users with clear, well-written guidance on topics including sports betting markets, live casino mechanics, responsible gambling tools, payment methods commonly used in Pakistan, and relevant sporting events such as Pakistan cricket, PSL, T20 internationals and ICC tournaments.

The Platform expressly does not:

• Accept bets, wagers or stakes from users;
• Hold, process or facilitate the transfer of funds on behalf of users;
• Issue, manage or administer gambling accounts;
• Act as agent, broker or representative for any Operator;
• Guarantee the accuracy, availability or terms of any Operator's products or promotions;
• Claim to be licensed, regulated or authorised by the Government of Pakistan, the Pakistan Telecommunication Authority (PTA), the State Bank of Pakistan, or any provincial authority.

Any bonus figures, jackpot amounts, promotional offers or payment processing times mentioned in Content are illustrative examples only. They do not represent confirmed, current or guaranteed Operator offers. Users must verify all such information directly with the relevant Operator prior to acting on it.

4 Account Eligibility & Age Restriction

By using the Platform you represent and warrant that:

• You are at least 18 years of age, or the higher minimum age required by the laws of your jurisdiction or the relevant Operator's licence conditions;
• You have the legal capacity to enter into a binding agreement under the laws of your jurisdiction;
• Your use of the Platform and any gambling activity you undertake as a result of information obtained from the Platform is lawful in your jurisdiction;
• You are accessing the Platform voluntarily and for personal, non-commercial informational purposes;
• You are not located in a jurisdiction where access to online gambling information is prohibited by law.

pk5d reserves the right to restrict access to the Platform, in whole or in part, where it reasonably believes that a User does not meet the eligibility requirements set out above.

5 Acceptable Use

You agree to use the Platform only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the Platform. Without limitation, you must not:

• Use the Platform for any fraudulent, deceptive or unlawful purpose;
• Attempt to gain unauthorised access to any part of the Platform, its servers or any associated systems or networks;
• Transmit any unsolicited commercial communications, spam or malware through or in connection with the Platform;
• Scrape, harvest or systematically extract data from the Platform without our prior written consent;
• Reproduce, republish, redistribute , modify or create derivative works from any Content on the Platform without our prior written consent;
• Use any automated tool, bot or crawler to access or index the Platform beyond the scope of standard search engine crawling;
• Post, upload or transmit any content that is defamatory, obscene, threatening, harassing or otherwise objectionable;
• Impersonate pk5d, its staff, or any other person or entity in connection with the Platform.

We reserve the right to investigate any suspected violation of these acceptable use provisions and to take appropriate action, including restricting or terminating access to the Platform without notice.

6 Intellectual Property

All Intellectual Property rights in and to the Platform and its Content are owned by or licensed to pk5d. This includes, without limitation:

• The pk5d name, logo and all associated trade marks and service marks;
• All written content, including betting guides, glossaries, responsible gambling articles and payment education material;
• The design, layout, structure, colour scheme and graphical elements of the Platform;
• All underlying source code, scripts and database architecture.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and view the Content on the Platform for your own personal, non-commercial informational use only. This licence does not include any right to:

• Download, copy or cache any Content beyond what is technically necessary for personal browsing;
• Modify, translate or create derivative works based on any Content;
• Distribute, sell, sub-licence or otherwise commercially exploit any Content;
• Remove or alter any copyright, trade mark or other proprietary notices from any Content.

Any use of Content outside the scope of this licence requires our prior written consent. Requests may be directed to our contact address set out in Section 13 of these Terms.

7 Disclaimers & Warranties

The Platform and all Content are provided on an "as is" and "as available" basis without any representation, warranty or guarantee of any kind, whether express, implied or statutory, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose or non-infringement;
• Any warranty that the Platform will be uninterrupted, error-free or free of viruses or other harmful components;
• Any warranty as to the accuracy, completeness, currency or reliability of any Content.

In particular, pk5d makes no warranty or representation that:

• Any bonus, promotional offer, jackpot figure or payment processing time described on the Platform reflects a current, confirmed or available Operator offer;
• The payment methods referenced on the Platform — including familiar Pakistani payment references such as Easypaisa, JazzCash, Raast, HBL, UBL, Meezan Bank and Bank Alfalah — are confirmed as available for gambling transactions at any particular Operator. These references are provided as contextual examples familiar to Pakistani users only and do not imply endorsement, affiliation or confirmed support for gambling transactions by any payment provider;
• Information regarding sporting events, including Pakistan cricket, PSL, T20 internationals or ICC tournaments, is complete, accurate or up to date at the time of reading.

8 Limitation of Liability

To the fullest extent permitted by Applicable Law, pk5d, its directors, officers, employees, agents and licensors shall not be liable to you or any third party for any:

• Direct, indirect, incidental, consequential, special or exemplary loss or damage;
• Loss of profits, revenue, data, goodwill or business opportunity;
• Financial loss arising from gambling decisions made on the basis of Content published on the Platform;
• Losses arising from your reliance on any illustrative PKR figures, bonus descriptions, payment method references or odds explanations published on the Platform;
• Interruption, suspension or termination of access to the Platform;
• Unauthorised access to or alteration of your data or communications in connection with the Platform.

Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under Applicable Law.

9 Privacy & Data

Your privacy is important to us. The collection, use and storage of any personal data in connection with your use of the Platform is governed by our Privacy Policy, which is incorporated into and forms part of these Terms.

By using the Platform you consent to the data practices described in the Privacy Policy. Key points include:

• We collect only the data necessary to operate and improve the Platform;
• We do not sell personal data to third parties for their own marketing purposes;
• You have rights to access, correct and request deletion of your personal data, as described in the Privacy Policy;
• Cookies and similar tracking technologies are used on the Platform in accordance with the Privacy Policy.

10 Responsible Gambling

pk5d is committed to promoting responsible gambling. All Content on the Platform that relates to betting or gambling includes appropriate context regarding financial risk and responsible play. We do not present gambling as a reliable source of income or glamourise irresponsible gambling behaviour.

We strongly encourage all users to:

• Set personal deposit, loss and session time limits before engaging in any gambling activity;

11 Governing Law & Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with applicable law. Users in Pakistan are reminded that gambling activity may be subject to restrictions under Pakistani law, including the Prevention of Gambling Act, 1977.

pk5d does not represent that the Platform or its Content is appropriate for use in all jurisdictions. It is the User's sole responsibility to ensure that their use of the Platform complies with all Applicable Laws in their jurisdiction.

12 Amendments to These Terms

pk5d reserves the right to revise, update or replace these Terms at any time and for any reason at our sole discretion. When we make material changes we will update the "Last Updated" date at the top of this page. We may also, at our discretion, notify users of significant changes through a prominent notice on the Platform.

Your continued use of the Platform after any such changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform immediately.

We recommend that you review these Terms periodically to stay informed of any updates. The version of the Terms in force at the time of any dispute shall govern the resolution of that dispute.
